Welcome to Avaroz Outdoor. These Terms of Service ("Terms") govern your access to and use of the website avarozoutdoor.com (the "Site") and your purchase of products from Avaroz Outdoor LLC ("Avaroz," "we," "us," or "our"), a New Jersey limited liability company. By using the Site or placing an order, you agree to these Terms.
- Eligibility & Account — You must be at least 18 years old and capable of entering a binding contract to purchase from the Site. You are responsible for the accuracy of the information you provide at checkout, including shipping address and contact details.
2. Products & Pricing — We make every effort to display our products, specifications, and pricing accurately. However, errors occur, and we reserve the right to correct pricing or descriptive errors, and to cancel and refund any order affected by such an error. Prices are in U.S. dollars and are subject to change without notice. Product colors and finishes may vary slightly from on-screen images.
3. Orders & Payment — Your order is an offer to purchase; it is accepted when we send an order confirmation. We may refuse or cancel any order, including for suspected fraud, pricing errors, or stock unavailability, in which case you will receive a full refund of any amount charged. Payment is due in full at the time of order and is processed through a secure third-party payment processor. We do not store your full payment card details.
4. Shipping & Delivery — Shipping terms, lead times, freight inspection requirements, and damage claim procedures are set out in our Shipping Policy, which is incorporated into these Terms. Title and risk of loss pass to you upon our delivery of the products to the carrier, except that we will work with you and the carrier to resolve freight damage claims made in accordance with our Shipping Policy.
5. Returns & Refunds — Returns are governed by our Returns & Refunds Policy, which is incorporated into these Terms. Certain products, including custom-configured and made-to-order items, are not eligible for return.
6. Product Warranties — Products sold on the Site are covered by their respective manufacturers' warranties, where offered. Avaroz will assist you in submitting warranty claims to manufacturers, but the warranty obligations belong to the manufacturer. EXCEPT AS EXPRESSLY STATED, PRODUCTS ARE PROVIDED "AS IS," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
7. Installation, Permits & Safe Use — You are solely responsible for determining whether a permit, licensed installation (including gas or electrical work), or homeowners association approval is required for any product you purchase, and for complying with all applicable codes and manufacturer installation instructions. Fire features, heaters, and gas appliances must be installed and used in accordance with manufacturer guidelines and local regulations.
8. Limitation of Liability — To the maximum extent permitted by law, Avaroz's total liability arising out of or relating to any order shall not exceed the amount you paid for that order, and in no event will we be liable for indirect, incidental, special, consequential, or punitive damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Intellectual Property — The Site and its content, including the Avaroz name, logo, text, graphics, and design, are the property of Avaroz Outdoor LLC or its licensors and are protected by intellectual property laws. You may not reproduce or use them without our prior written consent.
10. Acceptable Use — You agree not to misuse the Site, including by attempting to interfere with its operation, scraping content at scale, submitting false orders, or infringing the rights of others.
11. Governing Law & Disputes — These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your order shall be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
12. Changes to These Terms — We may update these Terms from time to time. The version posted on the Site at the time of your order applies to that order.
